Description

Situated in the heart of Ealing town centre sits Dickens Yard short stay apartments with one and two bedroom serviced apartments. All apartments are stylish and fully equipped with the essentials of home.  This includes a completely functional modern kitchen complete with fridge freezer, dishwashers, washer dryers, full oven and hob along with microwave oven. The lounge boasts a large TV along with Wi-Fi and wired broadband throughout the apartment.  The two bedroom apartments come complete with two bathrooms.

The apartments all have balconies overlooking a courtyard or the town centre (currently not to be used until further notice). There are plenty of shops, restaurants, cafes and gastro pubs on your doorstep.  Ealing Broadway Station is only a three minutes’ walk serving the Central Line, District Line and Heathrow Connect.

There is a full gym for residents (staying for 90 nights or more), secure underground parking and a 24 concierge

BOOKING TERMS & CONDITIONS

1. Applicable Regulations.

This agreement (terms and conditions) is governed by the laws of England and Wales. Each party irrevocably and unconditionally submits to the non–exclusive jurisdiction of the courts of England and Wales. The Hotel Proprietors Act 1956 applies to this agreement. The guests should refer to the notices posted in the premises regarding the limitation on liability. The guest may not invoke the statutory provisions applicable to residential leases, particularly as to security of tenure. The use of the apartment as a principal place of business is also prohibited. If a guest makes a reservation of more than 3 months or intends to occupy the apartment as his or her principle residence, the hiring will be subject to the guest signing an assured short hold tenancy agreement in such form as Waterside Apartments Ltd shall require.

No tenancy created

1.1.1 The Property is not for use as the principal or additional home or residence of the Guests. The Property is only to be used either as temporary accommodation, holiday accommodation, or as accommodation in connection with the business needs of you, your organisation and/or the Guests, as appropriate. No persons other than the Guests have the right to use the Property.

1.1.2 These Conditions amount to a contractual agreement for the use of the Property either as temporary accommodation ancillary to the requirements of your/the Guests’ business and do not create a tenancy of the Property (periodic or otherwise). No relationship of landlord and tenant is created between us and the Guests.

1.1.3 These Conditions constitute an excluded agreement under section (3A)(7)(a) of the Protection from Eviction Act 1977 (as amended) and cannot be construed as an assured tenancy under the Housing Act 1988 (as amended).

2. Completion of an Agreement (The Contract)

A booking shall only be confirmed following acceptance by the apartment provider of a guest’s reservation and receipt of the guest’s deposit (in accordance with clause 3). The apartment provider may elect at its own discretion to confirm reservations in writing.

3. Deposit

Reservations shall be binding only if guaranteed in full by credit card, or where prior credit arrangements have been agreed with  the apartment provider, or where a deposit has been received for such reservation. Reservations accepted by the apartment provider, subject to a deposit, will be held until fourteen days before scheduled arrival date. If the required deposit has not been received at least fourteen days prior to the scheduled arrival date, the reservation will automatically be cancelled. For bookings with a lead–time of less than fourteen days, guarantee by credit card is required.

Methods of Payment:

Credit Card: Visa, Access, Mastercard, Diners Card, American Express, Switch, Maestro, Delta.

Payments by credit card will subject to a 2% surcharge per payment made.

Payment by cheque cannot be accepted within 10 days of arrival date.

Bank Transfer: Any payments by bank transfer should reach our account net of all bank charges and a copy of the transfer should also be sent / faxed to our head office. Please ask your bank to identify your name and booking reference on the transfer.

4. Settlement of Invoice

Invoices are to be settled upon presentation without delay. The apartment provider will invoice for the entire duration of the stay on the date of arrival, except for stays extending beyond 28 days duration, in which event invoices will be presented in 28 day increments. In cases where payment for a guest’s stay has been arranged to be settled by someone other than the guest (the “Booker”), the guest will be required to provide a guarantee by credit card and the guest will be responsible personally for the payment if the “Booker” does not pay.

5. Accommodation and Occupancy

The price for hiring an apartment depends upon the duration of the stay.  The apartment provider is able to adjust at its sole discretion) are available on application to the company. The price of the rental includes the cost of water, electricity, gas, weekly cleaning and linen/towel services. The price of the rental excludes the cost of any additional services requested and does not include any personal insurance cover. The apartment provider recommends that the guest should take out all relevant insurance cover. The number of people permitted to occupy each apartment is limited to the number of beds. If the number of people permitted to occupy an apartment is exceeded, the apartment provider  reserves the right to charge for additional apartments. An inventory of equipment and utensils is placed in each apartment, and it is the obligation of the guest to verify the completeness of the inventory and the state of repair and condition of all equipment and utensils upon arrival in the apartment. In the event of discrepancies, the guest shall report such discrepancies within four hours of arrival at the apartment. If no discrepancy is reported the guest is deemed to have accepted the inventory. One parking bay per apartment is available for guests use. Guests must ensure that they only park in the numbered space allocated to them.

6. Modification to a Reservation / Duration of Stay

Subject to availability and at the discretion of the management, the length of stay can be extended, although there is no obligation to allocate the same apartment or to apply the same rate. If the duration of the reserved stay is to be shortened, and the guest needs to check out prior to the agreed date, the apartment provider will use its best endeavors to re–let the apartment and the resident will be offered a refund which may be subject to a cancellation charge. If Waterside Apartments Ltd (t/as West London Apartments) is unable to re–let the apartment no refund will be available to the resident. If the duration of the stay is to be shortened then the applicable tariff for the shorter duration shall come into force and be applied retrospectively, effective from the original date of arrival.

7. Arrivals / Departures

Apartments are available for occupation from 16:00 hours on the day of arrival to 11:00 hours on the day of departure. All additional hours will be charged as one day unless otherwise agreed. Access details will be provided prior to check–in date. On arrival you will be greeted in person, shown around your apartment and all your questions will be answered.

8. Cancellation / No Show

Notice of cancellation is required 14 days prior to arrival. There is a cancellation charge for bookings cancelled less than 14 days prior to arrival. If you cancel less than 14 days before arrival you will be charged a maximum of three days apartment charge. For stays of 1–6 days you would be charged only 1 days charge. For stays of 7 or more days you will be charged the maximum charge of 3 days accommodation. Where a booking is made less than 14 days prior to arrival you will be informed that this is not cancellable and that full payment for the period booked will be charged.

9. Obligations of the Resident

The apartment provider reserves the right to demand a security deposit on arrival in respect of any additional charges that may be levied. If a security deposit is not charged, valid credit/debit card details to cover any additional charges during your stay must be supplied at the time of booking and the apartment provider reserves the right to deduct from that card, without further notice, all amounts chargeable under this section. Additional charges include the following:

Cleaning:

The apartment will be made available to the resident in good order and the apartment provider expects the apartment to be left in the same good order on departure. If, at the apartment provider discretion, additional cleaning is required on departure, the cost of this cleaning will be charged as an additional charge.

Damages:

The guest is responsible for taking all reasonable care of the apartment and its contents. Except in the case of normal wear and tear, the guest will be responsible for making good any damage to the apartment or its contents which has occurred due to the negligence, wilful damage or irresponsible behaviour on the part of those occupying the apartment or their guests. The cost of the repair or replacement must be agreed and paid to the apartment provider. A final inventory and check of the apartment will be conducted on or before the guest’s departure. The apartment provider will charge a guest for any item of equipment or utensils missing from the inventory and/or for any damage caused to the apartment.

Keys:

The apartment provider will issue the guest with a set of keys and extra keys are available on request, however, if the issued keys are not returned on departure a charge of £50 plus VAT per set of keys will be made to the resident. If between the hours of 7pm and 8am a resident locks themselves out of the property and requires assistance to re–enter the property, the apartment provider reserves the right to charge £35 plus VAT call out charge in addition to the charge for the keys if lost.

Call Outs:

If the emergency call out number is used to call out assistance between the hours of 7pm and 8am for any purpose other than an emergency, the apartment provider reserve the right to charge the resident the call out fee of £50 plus VAT.

10. Liability

Neither the apartment provider nor its representatives:

take any liability for theft or damage to personal belongings in the apartment, car parking areas, storage facilities, or any other way during the period of the booking.

shall be liable to the resident for any special, consequential or incidental damages howsoever arising during the period of the booking; or shall have any liability for any complaint submitted after the resident has left the apartment.

Subject to this agreement the resident (and/or the booker) indemnifies and holds harmless the apartment provider and its affiliates, subsidiaries, officers, employees and agents from and against any loss (including legal costs and expenses) or liability incurred at law, in equity or otherwise by any of those indemnified arising from any personal injury or death caused by any negligent act or omission by the resident. All information supplied by the apartment provider and/or its representatives is given in good faith and is based on information available at the time. All reasonable measures have been taken to ensure the accuracy of any statement made, but neither the apartment provider nor our representatives shall be liable for any variation howsoever caused.

11. Restrictions

the apartment provider regrets that pets are not allowed in the apartments. Smoking is forbidden in any part of the demise of the apartment and all communal areas.

12. Termination

The agreement will be terminated immediately and without notice in the event of the resident’s non–performance of his/her obligations, or unsuitable conduct causing disturbance to other residents in the apartment building. The resident shall leave immediately on request.

13. General

The apartment provider  reserves the right to enter (either ourselves or through sub–contractors) the rented apartment at any time (with due regard to the convenience of the resident) for inspections, maintenance, cleaning and security purposes and to ensure due performance of this agreement by the resident. It is the intention of the parties that no term of this agreement may be enforced by any person who is not a party to this agreement (“Third Party”) notwithstanding that any such term may purport to confer or may be construed as conferring any benefit on such “Third Party” and irrespective of whether such “Third Party” is identified in this agreement. The Contracts (Rights of Third Parties) Act 1999 shall not apply to any provisions of this agreement. By making a reservation through the apartment provider, you will be deemed to have read and agreed to the above terms and conditions.
